Welcome to our community!

Thank you for taking the time to carefully read through our Terms and Conditions (‘Terms’). By booking a class or signing up for a membership, you are confirming that you have read the Terms and agree to be bound by them. These Terms together with the items listed below, constitute a contract between the client (“you,” “your,” “students”) and Yoga Heights (“we,” “us,” “our,” “studios”). Please ensure that you read and understand our Terms before attending any class at our studios. In addition to the policies listed here, Yoga Heights may, from time to time, post on our premises, website, or issue orally, additional rules for general safety reasons and respectful use of the studio.

General Studio Policies

New students are required to sign a waiver prior to participating in their first class, a copy of which is contained at the end of this document. As stated in the waiver, it is the student’s responsibility to ensure they are in proper physical condition to participate in the class and that they will inform the instructor of any current or previous medical conditions or injuries that may affect their participation.

Every student is required to sign in for each class they take at the front desk or via the Yoga Heights App. If you do not sign in for class, you may be charged a no-show penalty. Please try to arrive 5 minutes prior to the start time for Mat classes and 15 minutes prior to the start time for Aerial classes to ensure you are able to sign in and get set up for class in a timely manner.

We encourage you to wear comfortable clothing and remove any zippers, jewelry or other accessories that may cause discomfort, injury or damage to yoga mats and props. You may bring your own yoga mat, or loaner mats are available for a $2 rental fee. For Aerial Yoga classes, you may bring your own mat, or rent a mat for $2; you may also bring your own aerial silk and carabiners, or you may rent a silk and carabiners for $10. All other props are provided, but students may bring their own props if desired. We have water available on-site at all studio locations. Please leave shoes and outwear in the lobby areas, and do not bring open food containers into the studios.

Please follow any additional studio rules or guidelines provided by our staff.

If for any reason you feel anxious or uncomfortable during class, don't hesitate to exit immediately without permission or prior notification. While all our instructors strive to create a welcoming space for everybody at any level and in any state that day, we understand that this is your practice and it may not be the right time for it. If you need to leave, no worries. Quietly step out and we'll see you next time.

Purchasing Memberships, Classes and/or Products

You can find a description of our options and pricing for membership offerings, including class packs, single classes and special offers, on our website. Yoga Heights offers 15 class packs, monthly class memberships and unlimited memberships. All regular class packs and memberships may be used to enroll in regularly scheduled Mat classes and Aerial Classes. Additional materials (i.e. mat or aerial silk rental), classes, workshops, and events hosted/taught outside of our regularly scheduled classes may be paid for at the time of booking either on our website or in the studio before the class's start time.

Our introductory specials are only available to new students, or on promotional bases as determined by Yoga Heights. A single class may be purchased at any time and will be valid for 6 months. Class Packs do not expire. Yoga Heights also offers the option to purchase a Karma Pass up to 4 times per month. The Karma Pass allows you to reserve a space in class at a very discounted price.

Prices and terms for Memberships, Class Packs or Classes may change at any time. We will provide you with reasonable notice of any updates or changes in prices or terms before they become effective. If you do not want to renew your Membership under such new or modified prices or terms, you may cancel your Membership as described herein.

Once your initial Membership payment is processed, your Membership shall immediately commence. Monthly memberships will renew automatically for a period of (12) months and can be canceled at any time during this period with no penalty; memberships with a 6-month commitment will renew automatically for a period of (6) months and cannot be canceled during this period. You will be charged the rate stated at the time of purchase (plus applicable taxes) at the beginning of each billing period of your Membership via the payment method that you have provided. You are solely responsible for ensuring that your billing and payment information is correct to prevent your Membership from being canceled. If your payment method cannot be charged for any reason (such as expiration or insufficient funds), and you have not cancelled your Membership, you remain responsible for any uncollected amounts, and we will attempt to charge the payment method as you may update your payment method information. This may result in a change to the start of your next Membership period and may change the date on which you are billed for each period. In addition, we reserve the right to cancel your Membership if your payment method cannot be successfully charged.

You may cancel your Membership at any time with proper notice abiding by studio membership agreement terms, provided that you shall not be entitled to nor receive a refund of any kind or for any amount. If you cancel your Membership at any time during your Initial Membership Period or during a Renewal Membership Period, you shall continue to retain access to the applicable Membership for the remainder of the then-current Initial Membership Period or Renewal Membership Period. Gift Cards

Gift cards may be purchased and sent electronically through our online store or in-studio. Gift cards can be redeemed for memberships, classes, workshops, and/or retail purchases. Gift cards are non refundable and not redeemable for cash.

Payment Terms

Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before you receive your order. By entering into any transaction on our website or mobile app, you represent, warrant and covenant that all information you provide is true, correct and complete (including, without limitation, your credit card information and billing address); that any credit card transactions submitted by you are authorized; that charges incurred by you will be honored by your credit card company; that you will pay charges incurred by you at the posted prices, including all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order. If, in our sole discretion, we determine that: (i) your means of payment is not valid, (ii) a transaction is not authorized, (iii) your means of payment cannot be processed or verified at the time of any charge, (iv) a charge is disputed for any reason other than failure by us to deliver the item(s) purchased by you, (v) you have abused or misused promotions or promotion codes, as applicable, or (vi) you have otherwise used the Site to enter into an improper transaction, we reserve the right to immediately terminate any pending transactions, suspend your access to the Site, and terminate all of our obligations hereunder.

Payment Processing

By agreeing to these Terms, you consent that the payment processing services for products purchased on the Site are provided by a third-party payment processor.

Canceling a Reservation, Late Cancellations and No Shows 

You may cancel your reservation in a Mat class or Aerial class without penalty up to 30 minutes prior to the class start time. Upon a no-show or late arrival to a booked class, any credit used to reserve your space in class will not be returned to your account. If you have paid for a special class, workshop or course hosted/taught outside of our regularly scheduled classes, we may offer you the option to apply all or part of the price paid for the class towards the payment of another special class, workshop, event, or class package.

Refunds

If you need to cancel your membership early, made an accidental purchase or otherwise need to request a refund, please email info@yogaheightsdc.com. We are generally able to accommodate such requests for charges made within the past 30 days, however Yoga Heights reserves the right to refuse requests for a refund of membership dues, class or class pack fees, products and/or merchandise, and late and/or no-show penalties for reasons in accordance with our policies and customs.

Force Majeure 

We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms, if the delay was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labor, fuel, parts or machinery, power failure or breakdown in machinery.

Severability 

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
